Terms and Conditions

These terms and conditions (Rules) apply to the use of FNB.mobi (“the channel”) offered by First National Bank Limited, a subsidiary of FirstRand Bank Limited (FNB). These Terms and Conditions constitute an agreement between you (“the customer”) and FNB when you make use of FNB.mobi. This service is made available to you by us conditional upon your acceptance, without modification, of the terms of this agreement. Your access to and use of this service constitutes your agreement to and acceptance of this agreement. If you do not agree with any provision contained in this agreement, please do not use this service.

These terms and conditions are to be read together with our general terms and conditions which can be obtained at any FNB Branch. If there is a conflict between these term and conditions and the general terms and conditions, these terms and conditions will prevail.

1. Definitions (What we mean)

“You/the Customer”: means the person accessing the channel, whether FNB customer who has registered for Cellphone Banking or not.

“We/Us/Our/FNB”: means First National Bank (FNB), a subsidiary of FirstRand Bank Limited – a Licensed Bank and Financial Services Provider.

“Registered Cellphone Banking customer”: An FNB account holder who is registered to use Cellphone Banking

“Unregistered Cellphone Banking customer”: A person who has no affiliation to FNB

“The Channel”: FNB.mobi

2. Privacy
We respect your privacy and your personal information. For this reason, we have a Privacy Policy to let you know how we will treat any personal information that we collect, collate, , disclose or store about you. We will take reasonable measures, to protect your personal information and to keep it confidential, even when you are no longer our customer.

3. Security
Information that is transmitted over the internet or via other networks (wireless or otherwise) may be intercepted. While we take all reasonable precautions to ensure that FNB.mobi is secure, we will not be liable for any loss or damage you suffer as a result of your use of the FNB.mobi channel.

4. FNB cannot be held responsible for incorrect information or incomplete instructions
You are responsible for giving us the correct and complete information when you make use of the channel. We do not check or confirm any information and we are not liable for any loss or damage if you provide wrong or incomplete information. We will not be liable if you fail to complete an instruction or if you do not follow our instruction, which may result in losses to you or anyone else as a result.

5. No Offer
Unless clearly stated, all the content on this site will remain such. Content is merely an invitation to do business with us. It does not constitute advice or an offer or solicitation to buy or sell, or to enter into any transaction or investment with us.

6. We do not verify or confirm instructions
We can but are not required to, request any confirmation or verification of any transaction/instruction that you have submitted. This applies to any forms that have been submitted to FNB via www.fnb.mobi. We will act upon the electronic instruction received which was a result of an action performed on this website by the customer.

7. Communication
a. Monitoring of communication
For purposes of security, to maintain the integrity and security of our systems and the service channel, or to investigate and/or detect any unauthorized use of the channel and our system and/or for customers care, or when the law requires us to do so, we will monitor and record communication/traffic to the channel. You acknowledge that we monitor communication/ traffic to this channel primarily to ensure that users and consumers are not acting illegally, unlawfully or in breach of these Terms and Conditions as an inherent part of an to secure the effective operation of our website and information technology systems

b. How we communicate with you
You agree that we send you information about the service channel by any means, including a notice on the service channel itself or using electronic means, including an SMS, MMS or email.

8. No warranties
No warranties, whether implied or expressed, are given in respect of the FNB.mobi including in respect of their performance; quality; security; content; suitability; information; availability; accuracy; safety or reliability of FNB.mobi.

9. Liability/Exclusions/Indemnity
Your usage of the FNB.mobi channel is at your own risk. Although we have taken reasonable care to prevent any loss or harm to you, you agree that the Bank and its affiliates, shareholders, agents, consultants , employees are not liable for any direct, indirect, special, incidental or consequential damages or loss of any kind whatsoever, or howsoever caused (whether arising under contract, delict or otherwise and whether the loss was actually foreseen or reasonably foreseeable) arising as a result of your use of or inability to use FNB.mobi such loss or damage arises from our gross negligence or willful intent.

You also indemnify us against any damage, liability, claims or demand by third party or loss suffered by us arising from your use of FNB.mobi or your breach of these terms.

10. Availability of FNB.mobi
The channel may not be available from time to time due to routine maintenance or emergency repairs or because of the unavailability of electricity, any telecommunication system or network. In this case, you must use the Bank’s other available channels and take reasonable steps to minimize/prevent any loss or risk. These channels include but are not limited to ATM’s, www.fnb.co.za Call Centre/s, FNB Branches.

11. Changes/suspension/termination/cancelation of FNB.mobi
FNB.mobi is not subscription based and is open to the public. We may discontinue the channel or any products or services offered via FNB.mobi at any time at our sole discretion and will make an attempt to notify you either directly or through public communication.
